WHAT SHOULDN’T I DO?
Do not discuss or give a recorded statement to the other party’s insurance company. The other party’s insurance company will likely try to get information from you to limit your ability to make a claim and seek compensation. Let Feather Law Group talk to the insurance companies for you.
MEDICAL BILLS FOLLOWING A MOTOR VEHICLE ACCIDENT
Pennsylvania is a no-fault state, which means that, regardless of fault, your motor vehicle insurance pays the medical bills. Allow us to immediately report the accident to your insurance carrier and let them know that you were injured. Your insurance company will open up a claim, and that claim number will be used to pay your medical bills, up to your policy limits. There are no co-pays when using your automobile insurance PIP coverage. Once you exhaust your PIP insurance benefits, you would then be required to use your own health insurance to cover any additional medical treatment. If you do not have health insurance, we can help make arrangements with your medical providers to continue treatment contingent on a lien being placed on your legal case. Your automobile insurance cannot raise your rights for using your PIP benefits.
The responsible party’s insurance carrier is never required to pay your medical bills up-front. However, as part of any settlement or jury award, you will be entitled request to have all of your medical expenses reimbursed to you by the responsible party, including all co-pays and travel expenses you paid out of pocket for treatment. In addition, you can seek compensation to cover future anticipated medical costs.
WHAT IF THE OTHER DRIVER DOESN’T HAVE INSURANCE
WHAT IF I DON’T HAVE INSURANCE?
WHAT IF THE ACCIDENT WAS A HIT AND RUN?
Unfortunately, not every auto accident involves parties that have adequate insurance coverage. If you have been injured by someone who does not have insurance on their vehicle, we can assist you in bringing a claim under your own insurance policy that provides coverage for uninsured motorists. If you were injured but do not have car insurance of you own we have the experience to help find the proper insurance coverage to cover your medical treatment. If you were hit by someone who fled the scene and you do not have any insurance of your own we can help you bring a claim with a fund created by the State for circumstances where there are injuries but no insurance coverage.
DO I HAVE TO PAY OUT OF MY POCKET FOR REPRESENTATION?
Not at The Feather Law Group. Automobile incident statements are handled by us on a contingency basis, meaning we only get paid if we recover money for you.
HOW TO PROVE LIABILITY
Most automobile accidents, liability is clear. Either by admission or by the nature of the accident. If you were struck from behind by another vehicle, 95% of the time the other driver is at fault. However, in some accidents, it is not always so clear as to who is at fault and the parties involved all blame the others. In these cases, we first look to the police report for the traffic incident (if the police were contacted) to evaluate the reported version of events along with the opinion of the officer. If one of the parties received a traffic citation for a violation, that is often indicative of who they believe was at fault. If you do not agree with the police report, we have the option of deposing the other driver along with the police officer to further probe into the incident.
If there are very serious injuries or death as a result of a motor vehicle accident, and liability is not certain, we may make the decision to hire an accident reconstruction expert to help ascertain what happened and who was at fault. If we can’t prove that the other party was at fault, you will not be able to get compensation for your injuries.
